Nestlé Cereals British Paralympics Promotion 2024 Terms and Conditions

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry / claim instructions are deemed to form part of the Terms and Conditions and by entering this promotion all participants will be deemed to have accepted and be bound by the Terms and Conditions. Participants should retain a copy for their information.

The Promoter takes data protection seriously. By entering in this promotion, participants confirm that they have read the Privacy Policy and agree to these Terms and Conditions of the promotion. By submitting any information required as part of their participation into the promotion, participants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR) and Data Protection Act 2018.

Eligibility

1. This promotion is open to United Kingdom (England, Scotland, Wales and Northern Ireland), Channel Islands and Isle of Man residents aged 18+ only.
2. This promotion excludes employees and the immediate families of Cereal Partners UK (“the Promoter”), its affiliated companies, agents, or anyone else professionally connected to the promotion.
3. Entrants must enter the unique product code found on the relevant promotional pack reserve to allow entry into the promotion. Participants should also retain each proof of purchase for each entry showing the date of purchase during the main or late entry promotional period or prior to the start date as a result of some promotional stock reaching the market early and dated prior to date of entry as this will be required for claim purposes. Claims on multiple purchases require all the relevant receipts to be kept as these may be requested.
4. There is a maximum of one (1) entry per person per week permitted to the promotion throughout the duration of the promotional period.
5. A maximum of one prize type (either a VIP trip to Paris, or a Fitness tracker / smart watch) can be won per household throughout the duration of the promotional period.
6. Entries (bulk or otherwise) made from trade, consumer groups, agents, third parties or syndicates will not be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of programme, application, script, brute force, or any other automated means, that person’s entries will be disqualified, and any prize awarded will be void.
7. Each entry to the promotion must have a new pack purchase and unique receipt as part of the entry requirements. Anyone trying to circumvent the rules stated in these Terms and Conditions by using alternative details will be disqualified from this promotion.

 

Promotional Period

8. The main promotional period for the promotion will run between 00.00 on 26.06.24 and 23.59 on 13.08.24 with weekly draws each relevant week. The late entry period will run between 00.00 on 14.08.23 to 23.59 on 11.12.24. Any entries received outside the stated promotional periods will not be accepted.
9. For all the seven weeks of the main promotional period there will be a VIP trip to Paris for 4 to cheer our athletes on at the Paralympic Games available each week to be won. 
10. In total there are 7 prizes available to be won from all genuine, valid entries received during the main promotional period.
     

Each promotional week during the main promotional period the following draws will occur:

• Draw 1, will take place on the Wednesday 3^rd July from all valid entries received during the preceding week, starting at 00.00 Wednesday 26^th June to 23.59 on Tuesday 2^nd July 2024
• Draw 2, will take place on the Wednesday 10^th July from all valid entries received during the preceding week, starting at 00.00 Wednesday 3^rd July to 23.59 on Tuesday 9^th July 2024;
• Draw 3, will take place on the Wednesday 17^th July from all valid entries received during the preceding week, starting at 00.00 Wednesday 10^th July to 23.59 on Tuesday 16^th July 2024
• Draw 4, will take place on the Wednesday 24^th July from all valid entries received during the preceding week, starting at 00.00 Wednesday 17^th July to 23.59 on Tuesday 23^rd July 2024;
• Draw 5, will take place on the Wednesday 31^st July from all valid entries received during the preceding week, starting at 00.00 Wednesday 24^th July to 23.59 on Tuesday 30^th July 2024;
• Draw 6, will take place on the Wednesday 7^th August from all valid entries received during the preceding week, starting at 00.00 Wednesday 31^st July to 23.59 on Tuesday 6^th August 2024;
• Draw 7, will take place on the Wednesday 14^th August from all valid entries received during the preceding week, starting at 00.00 Wednesday 7^th August to 23.59 on Tuesday 13^th August 2024
  
  Prize draw entries will not roll over from one week to the next.
  There will be one late entry prize draw from all valid entries received throughout the late entry promotional period from 00 on 14 .08.24 to 23.59 on 11.12.24. This final late entry prize draw from all valid promotional entries will take place on 13.12.24 and 10 Fitness trackers /smart watches prizes will be available to be won.

 

11. 17 prizes available in total across the full duration of the promotion.

 

Entry Requirements

13. To enter for a chance to win one of the prizes available, entrants must:

    1. Purchase a participating promotional pack of Nestlé Cereals, subject to availability, whilst stocks last (see clause 15 for participating products) during the promotional period.
    2. Find the unique code from the promotional pack purchased. Only the correct product code (unique to a cereal product type) from the relevant promotional product type pack with the corresponding receipt will allow entry into the promotion.
    3. Visit nestle-cereals.com/uk/bringthecheer and follow the directions to the promotional microsite;
    4. Enter their full name, county of residence, email address, the correct product code from the purchased promotional product type pack and agree to the Terms and Conditions.
    5. Retain receipt. The proof of purchase details must be unique, clearly indicate the promotional product purchased and be dated within the Promotional Period or prior to the start date due to some promotional stocks making it into the marketplace early, and prior to the date of entry.

    Entrants will then be entered into the relevant prize draw (weekly or late entry) and will be notified, by email, within two (2) working days of the relevant prize draw taking place if they are a winner.
    
    14. Participants should retain each proof of purchase as these may be asked for as part of the verification process. Participating promotional products include:

15. Each entry can only be used once with a new / unique corresponding proof of purchase. Any used codes not intended for use in this promotion, may result in disqualification and all such entries will be declared void.
16. Incomplete, illegible, invalid, or misdirected entries, entries received outside any promotional period, entries by macros or other automated means (including systems which can be programmed to enter), and entries which do not satisfy the requirements of these Terms and Conditions in full will be disqualified and will not be counted. If it becomes apparent that an entrant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by using multiple IP addresses, using identities other than their own, the use of programme, alias or multiple accounts or any other automated means in order to increase that entrant’s entries into the Promotion in a way that is not consistent with the spirit of the Promotion, that entrant’s entries will be disqualified and any prize award will be void. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.

 

Prize Details 

17. There are 7 x overnight VIP experiences to the Paris Paralympic Games (28.08 -08.09) with tickets to at least two events and Fan Kit, travel (Eurostar or flight London to Paris return), 4* hotel (2 rooms) & breakfast for 4 people available to be won in the main promotion. 

The dates for these VIP trips are fixed and are as follows:

Visit to Paris and VIP dates 31.08 – 01.09.24 for the winners of the first 4 weekly draw dates 

and 

Visit to Paris and VIP dates of 06.09- 07.09.24 for the winners of the last three weeks draws.


There is also one Late Entry Draw for a chance to win one of 10 Fitness trackers /smart watch prizes.
 

VIP Experience

18. The winners from the first 4 weeks’ draws will attend the below events:

Saturday 31^st August, Para Swimming 16:00-21:30 with In Venue Hospitality.

Sunday 1^st September, Para Athletics 10:00-13:30. with the Fan Kit package, which is open from 08:30-10:00.

The winners from the latter 3 weeks’ draws will be attend the below events:

Friday 6^th September, Wheelchair Tennis 12:00-18:30. with In Venue Hospitality.

Saturday 7^th September, Para Athletics 10:00-13:00. Fan Kit package, open from 08:30-10:00.

 

• Winner will be notified by within 2 days of promotional draw closing dates.
• Winner and companions must be 18 years of age to attend.
• Winner must be available to travel to the event, on the dates highlighted in the various experience packages as specified by Promoter or forfeit the prize.
• The Promoter is not responsible if any scheduled event is delayed, postponed, or cancelled for any reason, including but not limited to pandemics, epidemics, local disease outbreaks, public health emergencies, and quarantines and winner will not be reimbursed for tickets.
• By accepting Prize, winners and their guest agree to abide by any terms, conditions and restrictions set forth on the event ticket and the event organizer.
• Winners understand and agree that Promoter has the right, in its sole discretion, to disqualify and remove any winner or his/her guest(s) from any activity at any time if the winner’s or his/her guest’s behaviour at any point is uncooperative, disruptive, or may or does cause damage to person, property, or the reputation of Promoter, and in such a case, the winner will still be solely responsible for all taxes and other expenses related to the prize.
• Winners and guests will provide all requested information pertaining personal information that will allow tickets for travel, accommodation, public ground transportation and event tickets to be issued not limited to e.g. passport, date of birth, nationality, covid vaccination status etc.
• Winners and guests understand the 4 star accommodation provided will be 2 rooms room of 2 people sharing.
• Promoter is not responsible if winner does not use ticket on any day of the event.
• Obtaining visas or tourist cards are the sole responsibility of the Winner and their guests and any cost associated is to be covered by the Winner.
• Winners and travel companions are solely responsible for obtaining travel insurance, valid passports and any other documents necessary for international travel.
• The Winners and their guests must not have any limitations upon their ability or rights to travel to and from both the Paralympic destination and the departing country. The right to refuse entry to either country is held by Passport control and countries’ authorities. Promoter or Prize Provider accepts no responsibility for ensuring the Winner or their guest are able to travel and are not responsible for any costs incurred should entry be refused by Passport control or the countries authorities.
• Travel restrictions, conditions and limitations may apply.
• Winners and travel companions are solely responsible to abide by destination countries laws and regulations.
• Promoter is not liable for any activities independently arranged by winner while in the Event destination or external excursions personally arranged in the local city.
• Promoter will not be held responsible for any goods or services provided outside of the allocated winning prize.
• Winners and travel companions are responsible for complying with any COVID-19 requirements set forth by Promoter, hotels/accommodations, event venues or other vendors offering services that are part of the trip prize. Failure to comply with any required COVID-19 requirements, may result in forfeiture of select elements of the prize or the entire prize.
• Prize is non-transferable and no substitution will be made except as provided herein at the Promoter’s sole discretion.
• Promoter reserves the right to substitute the prize for one of equal or greater value if the designated prize should become unavailable for any reason.

As of the Promotion start date, there exists an inherent risk of exposure to COVID-19 when travelling and in any public place where people are present. COVID-19 is a contagious disease that can lead to severe illness and death. By accepting this travel Prize and attending the festivals, winners and winner’s guests voluntarily assume all risks related to exposure to COVID-19.

OL has undertaken a number of measures to help mitigate the risk transmission of COVID-19 and other contagious illnesses, and the Event(s) may have enhanced health and safety measures in place due to the COVID-19 outbreak in order to prevent further spread of COVID-19. Purchaser (as well as any of Purchaser's guests/ invitees) may be required to follow any policies or protocols put in place by the local, state or federal governments, OL, the venue owner and/or operator, or any Event organizer in order to attend the Event, which may include, but not be limited to, masking, proof of vaccination or negative COVID-19 test (collectively, the "Protocols"). Refunds will not be provided in event you are denied access to an Event for failure to follow such Protocols. Purchaser, on behalf of itself and its guests/ invitees (including minors accompanying Purchaser or its guests/ invitees) acknowledge that COVID-19 is extremely contagious and that despite the measures OL, the venue owner and/or operator, or any Event organizer have implemented to help mitigate the risk of transmission, the elimination of risk of exposure and infection to COVID-19 is not currently possible, in connection thereto it shall be the sole responsibility of Purchaser, as well as any of Purchaser's guests/ invitees, including on behalf of any minors accompanying any of the foregoing, to utilize their best efforts to avoid any action or omission which may jeopardize their own safety or the safety of others.

IN FULL KNOWLEDGE AND COMPLETE ASSUMPTION OF ALL OF THE RISKS RELATED TO COVID-19, PURCHASER, FOR ITSELF AND ON BEHALF OF ITS GUESTS/ INVITEES (INCLUDING MINORS ACCOMPANYING PURCHASER OR ITS GUESTS/ INVITEES) (COLLECTIVELY, THE "RELEASING "), HEREBY IRREVOCABLY ACKNOWLEDGES THAT OL WILL NOT BE LIABLE FOR ANY INJURY, ILLNESS, DAMAGE, LOSS OR HARM TO ANY RELEASING PARTY OR SUCH RELEASING PARTY'S PROPERTY OR THE RELEASING PARTY'S DEATH OR DISABILITY, WHETHER IN CONNECTION WITH THE ILLNESS(ES), HARM(S), OR OTHERWISE, RESULTING OR ARISING OUT OF OR IN ANY WAY RELATED TO COVID-19, ON THE OCCASION OF THE PREPARATION FOR, TRAVEL FOR, ATTENDANCE AT, AND PARTICIPATION IN THE EVENT AND USING THE BENEFITS AND ELEMENTS OF THE PURCHASE INCLUDING, WITHOUT LIMITATION, INCLUDED SERVICES AND THIRD-PARTY PROVIDED SERVICES PURCHASED HEREUNDER UNLESS SUCH INJURY, ILLNESS, DAMAGE, LOSS, HARM, DEATH OR DISABILITY IS IMPUTABLE TO A FAILURE BY AN ORGANIZER TO PUT IN PLACE THE MANDATORY AND/OR APPROPRIATE MEASURES INCLUDING THE PROTOCOLS REFERRED TO IN THE PARAGRAPH ABOVE

If the Tickets are obtained or used in breach of the terms and conditions of entry, they will be automatically void. The bearer will be refused entry and, if already in the Event, will be ejected, in either case without refund.

• To the fullest extent permitted by law the Promoter excludes any and all liability for any loss, damage or injury occurring to you or any third party arising from your entry into the promotion or arising from your acceptance and use of the Prize.
• By entering this promotion, the winner explicitly agrees to the General Terms and Conditions of the event.

Winning tickets will be authorised for use as part of the relationship between NESTLÉ Cereal Partners and the Paralympics.

Paris 2024 Paralympic Games Hospitality reserve the right, without refund of any portion of the price paid or other compensation to you, to refuse admission or to eject any person from any Event, hotels, venues or other elements of your Package, and/or withdraw or refuse to begin services or provide goods to any person, who fails to comply with this Policy or policies put in place for an Event, the rules of an applicable third party, and/or applicable law or ordinance, in whole or in part, or whose conduct is deemed by us or the applicable third party as disorderly, illegal, abusive, threatening, aggressive, or otherwise a nuisance to other consumers, or out of compliance with this Policy or the applicable third party's terms, conditions, rules or policies (all of the above in this sentence, collectively, "Removal Behaviour").

Further, for the purpose of preventing the risk of fraud, it is forbidden, within a sport event venue, to bet in any way whatsoever (electronically or otherwise) on any elements, results or events linked to the sports event or to use any means of communication (electronic or otherwise) to gather sports-related data intended for betting purposes. Violation of the preceding sentence shall be considered within the meaning of Removal Behaviour.

The location, date and time of an Event and any other elements of your hospitality are subject to change (including, but not limited to, cancellation, postponement or relocation) by OL, P24, the IOC or any other third party responsible for the staging of an Event or other elements of your Package (collectively, the "Organizers"), respectively, in each of their sole discretion, and no such change shall entitle you to a refund or any other remedy in the event that you cannot attend the Event for any reason due to such change unless otherwise specified in this Policy or agreed to in writing by OL or advertised as such at the time of purchase.

In accordance with applicable French regulations and, more specifically, Article L.613-3 of the French Internal Security Code, you and your belongings may be searched upon entry to or otherwise in connection with your attendance at any of the Events included in your Package. You hereby consent to such searches and any other security protocols or Protocols, and forever waive any and all related claims that could arise. If you elect to withdraw such consent to such searches or fail to follow any Protocols, you may be denied access to an Event, or removed from an Event, without refund or other compensation. Under certain facility rules, certain items may not be brought into certain events or premises, including, without limitation, alcohol, drugs, controlled substances, weapons of any kind (including toy weapons), professional cameras and recording devices, laser pointers, strobe lights, irritants, various forms of containers, and any other item noted as prohibited or other information released by us, the IOC or P24 including, without limitation, P24’s “List of Prohibited Items” as set forth in P24 Ticketing Terms & Conditions and/or any other applicable P24 Policies. From time to time in relation to an Event, you and your guests may be subject to a criminal background check prior to such event. You (on your behalf and their behalf) consent to such background checks and waive any related claims that may arise. If you and/or your guests elect not to consent to such background checks, we may cancel your purchase in our discretion. Breach of this Policy, the Protocols, or any of OL's or any applicable third party's terms, conditions, rules or policies will terminate your license to attend the Event without refund or other compensation. If you and/or your guests do not satisfactorily pass any such background check, you may be entitled to a refund in connection to the element of the Package you are unable to attend as a direct result of participating in, and subsequently failing to pass, any such background check.

Winner selection and Weekly Prize Draw

19. Each week of the main promotional period, winners will be drawn by an independently verified random computer process from all valid entries received between 00.00 – 23.59, Wednesday to Tuesday (for the relevant week during the main promotional period.
20. The weekly draws will take place on the Wednesday following the previous week’s entries as highlighted to win one of the VIP Experiences available. Turn around dates for the latter draws will be specifically highlighted.
    
     
21. Winners will be contacted on the email address that they used to enter the promotion as soon as possible but within two (2) days of each draw taking place and will be asked to follow the instructions provided to verify and ensure contact is initiated to allow for action and travel agreements to be organised to claim their experience. Winners will need to provide information which will include providing personal details (including home address and passport information) to verify that the win is genuine and valid and start to travel & accommodation process. Each winner’s county of residence will be requested for the purpose of the winners list if no objection is received.
22. The Promoter will make reasonable efforts to contact the winners in time to ensure the experience can be fulfilled. This will involve quick turn arounds. Inaccurate information may result in the prize being forfeited. Two (2) reminder emails will be sent out to winners. If a winner has not responded to either email notification within the stated time scale (14 days for the initial three winners. Note tight turnaround required and will be highlighted in communications), or if a selected winner is ineligible, rejects their prize, or is otherwise in breach of these Terms and Conditions, or unable to take up the prize for any other reason, the Promoter reserves the right to withdraw the prize, forfeit this original win and to reallocate the prize to a reserve winner drawn at the same time as the original. The process of reserves will repeat twice after each draw if relevant and time allows. Winners should retain their notification email message until their win has been verified. Entrants are encouraged to monitor their email account during this time, including checking their junk and spam folders, in case they are a winner and also to be aware of the timings to turn administration around.
23. Winners will be sent an email asking them to complete their information. Once winners have been validated. Winners’ details will be provided to the fulfilment team. The fulfilment team will then be in touch to provide itineraries, hotel information, ticket download details and all other information relating to their trip. Winners’ details will also be provided to the travel partner, who will be obtaining information regarding the winners and the guest to book the subsequent transport.

 

Late Entry Prize Draw

24. A Late Entry Prize Draw for 10 Fitness trackers /smart watch prizes will take place from all valid entries received between 00 on 14.08.24 to 23.59 on 11.12.24. Winners will be drawn via an independently verified computer process on 13.12.24.
25. The Promoter will make reasonable efforts to contact the winners. After successful contact and the subsequent receipt of relevant personal information to allow verification, the claim will be processed, and the prize dispatch arranged. The late entry draw winners will be contacted within two (2) days of the draw taking place on the email address that they used to enter the promotion. Winners must follow the instructions provided to claim their prize within 14 days from notification, this will include providing personal details (including home delivery address) to verify that the win is genuine and valid. Failure of any winner to claim their prize within these timescales or if a selected winner is ineligible, rejects their prize, otherwise in breach of these Terms and Conditions, or unable to take up the prize for any other reason allows the Promoter to withhold the prize from the original winner who will have been deemed to have forfeited the prize. The Promoter reserves the right to allocate the prize to the reserve winner drawn next in line during the late entry draw. Winners should retain their notification email message until their win has been verified. This process will continue until all winners and reserves for any prizes outstanding have been contacted as detailed. The reserve winner contacting process will continue until up to two (2) reserves have been contacted for any outstanding prize. Any prizes that have not been claimed after this process has been executed will become null and void. Entrants are encouraged to monitor their email account including checking their junk and spam folders during this time in case they are a winner. 
     
26. The Late Entry Draw prizes will be fulfilled by being sent by secure signed-for carrier to the provided home postal address within 28 days of sending confirmation of despatch details. Winners will receive confirmation that their prize has been verified and despatched.
27. Winners should allow up to 28 days for their prize to arrive by the appropriate delivery method after valid claim of their prize and completion of the verification process.

 

General

28. The Promoter will be the final arbiter for all decisions, which are final and binding.
     
29. Proof of entry is not proof of purchase. Responsibility cannot be accepted for entries that are lost, damaged, or delayed, nor any associated costs to entrants.
30. Winners will be subject to a full verification process. Winners may be asked to provide a copy of each relevant proof of purchase dated prior to date of entry and showing the date of purchase either prior to the promotional period to reflect the fact that some promotional stock has reached the marketplace early, or during the promotional period for each entry as proof of a valid entry in order to verify their claim. If more than one entry has been received, the Promoter reserves the right to request all related proof of purchases.
31. Prizes are not transferable or exchangeable unless otherwise stated herein and cannot be redeemed for cash or any other form of compensation. In the event for any reason the user does not take any element of the prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the user and neither cash nor any other form of compensation will be supplied in lieu of that element of the prize, unless otherwise agreed. If, due to unforeseen circumstances, the prize or part of the prize is not available, the Promoter reserves the right to substitute another prize for it, in its sole discretion, of equal or higher value. Unless otherwise agreed in writing by the Promoter, the prize will only be awarded directly to the winning participant.
32. All entrants will be required to provide a genuine email address that is personal, valid, and accessible throughout the promotion. In the event that the specified information is not provided or is incorrect or an alias, the entry may be considered incomplete and therefore the Promoter reserves the right to invalidate the entry. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize.
33.  In the event of an email address becoming inaccessible during the promotion, the Promoter is not able to retrieve and amend any existing entries to a new email address.
34. Limitations of liability: Neither the Promoter, its agents or anyone professionally connected to the promotion, assume any responsibility or liability for:

 

i. Any incorrect or inaccurate entry of information, or for any faulty, erroneous or failed electronic data transmissions;

ii. Any communications line failure, regardless of cause, with regards to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this promotion;

iii. Inaccessibility or unavailability of the internet or the microsite or any combination thereof.

35. Conduct of entry: The Promoter reserves the right at its sole discretion to disqualify any entrant found to be tampering with the entry process or the operation of the promotion; or to be acting in any manner deemed by the Promoter to be in violation of the Terms and Conditions; or to be acting in any manner deemed by the Promoter to be disruptive.
36. If, for any reason, any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion cancel, modify or suspend the promotion or invalidate any affected entries. If an act, omission, event, or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to entrants in order to avoid undue disappointment.
37. The Promoter reserves the right to verify all entries including but not limited to asking for proof of address, purchase, packaging and identity details (passport, driving licence or equivalent) which they must provide within seven (7) calendar days or less as requested in the communication and to refuse to award a prize or withdraw prize entitlement, and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of this promotion’s entry requirements or otherwise, where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means.
38. Subject to Cereal Partners UK Privacy Policy, the surnames and counties of residence of all winners of the prizes from all the weekly draws and prize winners from the Late Entry Prize Draw will be available by sending an email request to services@uk.nestle.com with ‘WINNERS LIST: 2024 NESTLÉ CEREALS PARALYMPIC PROMOTION’ in the subject line, for a period of three (3) months following the end of the main promotion period and Late entry draw period. When contacting this email address, your request will be actioned in line with Nestlé’s Privacy Policy. If any winner objects to their information being published, then they can contact the Promoter by emailing UKI.dataprotection@uk.nestle.com with the subject line ‘WINNERS LIST: 2024 NESTLÉ CEREALS PARALYMPIC PROMOTION’ . We may nevertheless disclose the information to the Advertising Standards Authority if required to do so. We reserve the right to refuse any or all such requests.
39. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using a prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
40. By taking part in the promotion the prize winners agree that the Promoter may contact them to ask whether they want to participate in marketing activities relating to this promotion only. Such publicity may include, without limitation, the entrants’ name and/or if consent given, image or statements made by entrants concerning the promotion and/or prize obtained as part of the promotion. The winner(s) are not obliged to agree to any such requests.
41. If any of these clauses should be determined to be illegal, invalid, or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
42. The Promotion and these Terms and Conditions will be governed by the laws of the participating country but any disputes as to the meaning of these Terms and Conditions will be subject to the exclusive jurisdiction of the participant’s local courts.

 

Data Protection

43. The Promoter will only use the personal details supplied for the administration of the promotion and the auditing of the entries where necessary and for no other purpose, unless we have your consent/you have opted-in to receive future marketing communications. The surnames and counties of residence of verified winners will be made available as set out in the relevant clause above and winners can object to this by emailing Dataprotection@uk.nestle.com. Otherwise, your personal details will at all times be kept confidential and in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018 as applicable, details will be kept for a period of three (3) months after the end of each promotional period and then securely deleted. Click herefor the Promoter’s Privacy Policy. By participating in the promotion, you agree to the use of your personal data as described here. You can withdraw your consent at any time.
