FULL TERMS & CONDITIONS

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry / claim instructions are deemed to form part of the Terms and Conditions and by entering this promotion all entrants will be deemed to have accepted and be bound by the Terms and Conditions. Entrants should retain a copy for their information.

The Promoter takes data protection seriously. By entering in this promotion, entrants confirm that they have read the Privacy Policy and agree to these Terms and Conditions of the promotion. By submitting any information required as part of their participation into the promotion, entrants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR) and Data Protection Act 2018.

Eligibility

1. This promotion is open to United Kingdom (England, Scotland, Wales and Northern Ireland), Channel Islands, Isle of Man and Republic of Ireland residents aged 18+ only.
    
2. This promotion excludes employees and the immediate families of Cereal Partners UK (“the Promoter”), its affiliated companies, agents, or anyone else professionally connected to the promotion.
    
3. Purchase necessary. Internet access and camera access are required to enter the promotion. Entrants must find and submit the valid promotional product entry code to allow entry into the promotion. Entrants should retain their promotional packaging and each proof of purchase showing date of purchase during the main or late entry promotional period (which they have uploaded) and prior to date of entry as this will be required for claim purposes. Entries on multiple purchases require all promotional packaging and relevant receipts to be kept as they may be requested.
    
4. There is a maximum of one (1) entry per person per week (Monday to Sunday) permitted to the promotion throughout the main entry period. There is a maximum of one (1) entry per person throughout the late entry period. There is a maximum of one (1) win of each of the draw prize types per person, throughout the duration of the promotional period.
    
5. Entries (bulk or otherwise) made from trade, consumer groups, agents, third parties or syndicates will not be accepted. If it becomes apparent that an entrant is using a computer(s) to circumvent this condition by, for example, the use of programme, application, script, brute force or any other automated means, that person’s entries will be disqualified, and any prize awarded will be void.
    
6. Each entry to the promotion must have a new pack and unique receipt as part of the entry requirements. Anyone trying to circumvent the rules stated in these Terms and Conditions by using alternative details will be disqualified from this promotion.

Promotional Period

7. The main promotional period will run between 00.00 on 23.09.24 and 23.59 on 17.11.24. The late entry period will run between 00.00 on 18.11.24 to 23.59 on 10.01.25. All entries received outside the stated promotional periods will not be accepted.
    
8. Each week in the main promotional period there will be a chance to win one of the following prizes:
   
   Two (2) x Xbox Series S consoles, three (3) x Xbox Stereo Headsets and six thousand (6000) Xbox Game Pass Ultimate subscriptions – 30-day use (valid for new Xbox Game Pass Ultimate members only).
    
9. There are eight (8) weekly prize draws in total, six thousand and five prizes are available to be won from all genuine, valid entries received each relevant week. Therefore, in total, 16 x Xbox Series S consoles, 24 x Xbox Stereo Headsets and 48000 Xbox Game Pass Ultimate subscriptions – 30-day use (valid for new Xbox Game Pass Ultimate members only) will be available to be won as prizes across eight (8) weekly prize draws.
   
   Each promotional week during the main promotional period the following draws will occur:

Prize draw entries will not roll over from one week to the next.

10. There will be one Late Entry Prize Draw from all valid entries received throughout the late entry period from 00.00 on 18.11.24 to 23.59 on 10.01.25. This prize draw from all valid promotional entries will take place on 13.01.25. 2000 x Xbox Game Pass Ultimate subscriptions - 30-day membership prizes available to be won (for new subscribers only). These passes must be registered for use by 11.02.25.

Entry Requirements

11. To enter a prize draw for a chance to win a prize, during the promotional period entrants must:
    a.    Purchase a participating promotional product pack of Nestlé Cereals (see clause 13 for participating promotional packs);
    b.    Find the promotional product entry code from the promotional pack purchased. This will be found on the back of pack under "HOW TO ENTER" section, inside the rectangular box - the 8 digit code will be your product code;
    c.    Scan the on-pack QR code or visit www.nestle-cereals.com/uk/Xbox and follow the directions to the promotional entry instructions;
    d.    Enter your full name, email address and county, and upload a copy of the proof of purchase receipt plus the promotional product entry code from the promotional pack. The proof of purchase details uploaded must be unique, clearly indicate the product purchased and be dated within the promotional period and prior to the date of entry.
    e.    Entrants will then be entered into the corresponding prize draw.
    f.    Incorrectly entered codes will receive an error message and will not be entered into a prize draw.
     
12. Proof of purchase details can only be used once. Entrants who do not give the correct information or those who make an entry on someone else’s behalf will be disqualified. The Promoter reserves the right to refuse any uploaded proof of purchase / receipts that:
    a.    Are out of focus / blurry;
    b.    Do not have the correct product clearly visible;
    c.    Show a purchase date outside of the Promotional Period;
    d.    Show store locations in geographical locations outside the stated promotional area; or
    e.    Are not unique to the individual.
     
13. Entrants should retain each proof of purchase and promotional product packaging as these will be needed for verification purposes.

15. Incomplete, illegible, invalid, or misdirected entries, entries received outside any Promotional Period, entries by macros or other automated means (including systems which can be programmed to enter), and entries which do not satisfy the requirements of these T&Cs in full will be disqualified and will not be counted. If it becomes apparent that an entrant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by using multiple IP addresses, using identities other than their own, the use of programme, alias or multiple accounts or any other automated means in order to increase that entrant’s entries into the Promotion in a way that is not consistent with the spirit of the Promotion, that entrant’s entries will be disqualified and any prize award will be void. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.
     
16. Each promotional product entry code (unique to a cereal product type) must be accompanied for an entry with a corresponding proof of purchase. Any attempts to enter the promotion more than once without relevant genuine individual receipts, the use of codes from non-promotional packs, or the use of any codes not intended for use in this promotion, may result in disqualification and all such entries will be declared void.

Prize Details

17. There are 2 x Xbox Series S consoles, 3 x Xbox Stereo Headsets and 6000 x Xbox Game Pass Ultimate subscriptions -30 days use (for new subscribers only) available to be won in each of the 8 weekly prize draws.
     
18. There is also one late draw for 2000 x Xbox Game Pass Ultimate subscriptions – 30-day use (for new subscribers only).

These codes for Xbox Game Pass Ultimate are for new users only- winners will each receive a 30-day use Xbox Game Pass Ultimate code on registration.

Game Pass Conditions:

Unless you cancel, you will be charged the then-current regular membership rate when the Xbox Game Pass Ultimate subscription ends (at the time of this notice £12.99/€14.99 per month standard). User is free to cancel the subscription before the end of this first 30-day period if they don’t want to renew it and be charged on their credit card.
   

20. Prizes are as specified and are non-transferable. There are no cash or other prize alternatives available in whole or in part, except that in the event of circumstances outside of its control, the Promoter reserves the right to substitute similar alternatives of equal or greater value. Unless otherwise agreed with the Promoter, a winner is not permitted to transfer the right to take up a prize to anyone else.

Winner selection and notification

Weekly Prize Draw

21. Each week of the promotion an independently verified and audited computerised random prize draw process will be carried out from all valid entries received between 00.00 – 23.59, Monday to Sunday within the relevant week during the main promotional period.
     
22. The eight (8) weekly draws will take place on the Monday following the previous week’s entries as highlighted above
     
23. The first two entries drawn will win the Xbox Series S consoles. The next three entries will win the Xbox Stereo Headset, followed by the 6000 prizes of Xbox Game Pass Ultimate subscriptions - 30-day use.
     
24. Winners of the Xbox consoles and headsets will be contacted on the email address that they used to enter the promotion within two (2) working days of each draw taking place and will be asked to follow the instructions to claim their prize within 14 days from first notification, this will include providing ID and proof of home address.
     
25. A winner will be redrawn if they have won previously.
     
26. The Promoter will make reasonable efforts to contact the winners and then after successful contact, the Promoter will require relevant personnel information (name, address, confirmation over 18) to allow the verification and then fulfilment of the claim and to arrange the prize dispatch. One (1) reminder email will be sent out to winners. Inaccurate information, however, may result in the prize being forfeited. If a winner has not responded to reminder email notifications after 14 days of first notification or if a selected winner is ineligible, rejects the prize, or is otherwise in breach of these Terms and Conditions, or unable to take up the prize for any other reason, the Promoter reserves the right to withdraw the prize and to forfeit this original win and to reallocate the prize, if possible, to a reserve drawn at the same time as the original draw. The process will repeat for three months after which any remaining prizes will be withdrawn from the promotion. Winners should retain their notification email message until their win has been verified. Entrants are encouraged to monitor their email account during this time in case they are a winner.
     
27. Once verified, the Xbox consoles and headsets winners will be contacted within seven (7) days of valid claim and the completion of the verification process via email used to enter the promotion to confirm dispatch details.
     
28. Prizes (Xbox Console & Headsets) will be fulfilled by being sent by secure signed-for carrier to the provided postal address.
     
29. Winners should allow up to 28 days for their physical prize to arrive after successful claim of their prize and the completion of the verification process.
     
30. Winners of the Xbox Game Pass Ultimate subscriptions. Each week the Xbox Game Pass Ultimate prize winners will be notified within 2 working days of the weekly prize draw.  On completion of the system verification checks, the Xbox Game Pass Ultimate prize will then be provided via the email address used on entry immediately and will be available for winners to use instantly online with an Xbox account. Late Entry Prize Draw

31. A late entry draw will take place from all valid entries received between 00.00 on 18.11.24 to 23.59 on 10.01.25, via an independently verified and audited computerised random prize draw process on 13.01.25. The Promoter reserves the right to add any unclaimed Xbox Game Pass Ultimate prizes from the main promotional period to the Late Entry Prize Draw if a winner is ineligible or are an existing subscriber.
     
32. The winners will be notified within 2 working days of the Late Entry Prize Draw to advise that their winning Xbox Game Pass code will be provided via email immediately after passing system verification checks. Winners should retain their notification email message until their win has been verified. If a winner is ineligible, the prize will be redrawn. This process will repeat twice after which any remaining prizes will be withdrawn from the promotion. Entrants are encouraged to monitor their email account during this time in case they are a winner.
     
33. Prizes will be fulfilled by email to the email address registered on entry.
     
34. Winners will receive an email with the code details after successful checking of the claim of their prize and as advised.

General

35. The Promoter will be the final arbiter for all decisions, which are final and binding. 
     
36. Proof of entry is not proof of purchase. Responsibility cannot be accepted for entries that are lost, damaged or delayed, nor any associated costs to entrants with the exception of the purchase required to enter the promotion.
     
37. All entrants will be required to provide a genuine email address that is personal, valid and accessible throughout the promotion. In the event that the specified information is not provided or is incorrect or an alias, the entry may be considered incomplete and therefore the Promoter reserves the right to invalidate the entry. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize.
     
38. In the event of an email address becoming inaccessible during the promotion, the Promoter is not able to retrieve and amend any existing entries to a new email address.
     
39. The promotion is carried out in ROI under Lottery Licence issued by Dundalk District Court and held by Dundalk Simon Community, Seatown House, Jocelyn St, Townparks, Dundalk, Co. Louth.
     
40. Limitations of liability: Neither the Promoter, its agents or anyone professionally connected to the promotion, assume any responsibility or liability for:

i. Any incorrect or inaccurate entry of information, or for any faulty, erroneous or failed electronic data transmissions;

ii. Any communications line failure, regardless of cause, with regards to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this promotion;

iii. Inaccessibility or unavailability of the internet or the microsite or any combination thereof.

41. Conduct of entry: The Promoter reserves the right at its sole discretion to disqualify any entrant found to be tampering with the entry process or the operation of the promotion; or to be acting in any manner deemed by the Promoter to be in violation of the Terms and Conditions; or to be acting in any manner deemed by the Promoter to be disruptive.
     
42. If, for any reason, any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion cancel, modify or suspend the promotion or invalidate any affected entries. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions (including but not limited to global or regional health crises, weather conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, epidemic, pandemic, famine, plague or other natural calamities and acts of God), the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to entrants in order to avoid undue disappointment.
     
43. The Promoter reserves the right to verify all entries including but not limited to asking for the relevant packaging and proof of address, purchase and identity details (passport, driving licence or equivalent) which they must provide within seven (7) calendar days and to refuse to award a prize or withdraw prize entitlement, and/or refuse further participation in the promotion and disqualify the entrant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of this promotion’s entry requirements or otherwise, where a entrant has gained unfair advantage in participating in the promotion or won using fraudulent means.
     
44. Subject to Cereal Partners UK Privacy Policy, the surnames and counties of all Xbox Series S Console and Xbox headset  prize winners will be available by sending an email request to consumer.services@uk.nestle.com with ‘WINNERS’ LIST: 2024 NESTLÉ CEREALS Xbox Promotion’ in the subject line, for a period of three (3) months following the end of the main promotion period. When contacting this email address, your request will be actioned in line with Nestlé’s Privacy Policy. If any winner objects to their information being published, then they can contact the Promoter by emailing UKI.dataprotection@uk.nestle.com with the subject line ‘WINNERS’ LIST: 2024 NESTLÉ CEREALS Xbox Promotion’. We may nevertheless disclose the information to the Advertising Standards Authority if required to do so. We reserve the right to refuse any or all such requests.
     
45. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using a prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
     
46. By taking part in the promotion the prize winners agree that the Promoter may contact them to ask whether they want to participate in marketing activities relating to this promotion only.  Such publicity may include, without limitation, the entrants’ name and/or if consent given, image or statements made by entrants concerning the promotion and/or prize obtained as part of the promotion. The winner(s) are not obliged to agree to any such requests.
     
47. If any of these clauses should be determined to be illegal, invalid, or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
     
48. The Promotion and these Terms and Conditions will be governed by the laws of the participating country but any disputes as to the meaning of these Terms and Conditions will be subject to the exclusive jurisdiction of the entrant’s local courts.

Data Protection

The Promoter will only use the personal details supplied for the administration of the promotion and the auditing of the entries where necessary and for no other purpose, unless we have your consent. The surnames and counties of residence of verified console and headset winners will be made available as set out in the relevant clause above and winners can object to this by emailing UKI.Dataprotection@uk.nestle.com. Otherwise, your personal details will at all times be kept confidential and in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018 as applicable. Click here for the Promoter’s Privacy Policy. By participating in the promotion, you agree to the use of your personal data as described here. You can withdraw your consent at any time. For the purpose of this promotion, requests to delete personal data can only be actioned after the promotion has concluded and the winner(s) accepted their prize. Any data obtained via this promotion will be deleted after three (3) months of the promotional end dates with the exception of the winners and reserves whose data will be deleted after fulfilment of the prize.
